ONAC/MYRIVR (“us”, “we”, or “our”) operates the ONAC/MYRIVR mobile application (the “App”). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our App.
By using the App, you agree to the collection and use of information in accordance with this Privacy
Policy.
1. Information Collection and Use
We collect several types of information for various purposes, including providing and improving our
App.
a) Personal Information
While using our App, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Information”). Personal Information may include, but is not limited to:
– Name
– Email address
– Phone number
– Address
– Date of birth
– Gender
b) Usage Data
We may also collect information on how the App is accessed and used (“Usage Data”). This Usage Data may include information such as your device’s Internet Protocol address (IP address), browser type, browser version, the pages of our App that you visit, the Time and date of your visit, the Time spent on those pages, unique device identifiers, and other diagnostic data.
c) Location Data
We may use and store information about your location if you grant us permission to do so (“Location Data”). We use this data to provide features of our App, and to improve and customize our App.
You can enable or disable location services when you use our App at any time by changing the permissions in your device’s settings.
2. Use of Data
ONAC/MYRIVR uses the collected data for various purposes:
– To provide and maintain our App
– To noƟfy you about changes to our App
– To allow you to parƟcipate in interactive features of our App when you choose to do so
– To provide customer support
– To gather analysis or valuable information so that we can improve our App
– To monitor the usage of our App
– To detect, prevent and address technical issues
– To send you promoƟonal and marketing communications, if you opt-in to receive them
3. Disclosure of Data
We may disclose your Personal Information in the good faith belief that such action is necessary to:
– Comply with a legal obligation
– Protect and defend the rights or property of ONAC/MYRIVR
– Prevent or investigate possible wrongdoing in connection with the App
– Protect the personal safety of users of the App or the public
– Protect against legal liability
4. Security of Data
The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
5. Children’s Privacy
Our App does not address anyone under the age of 13 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from children without verification of parental consent, we will take steps to remove that information from our servers.
6. Changes to This Privacy Policy
We may update our Privacy Policy from time to time. We will noƟfy you of any changes by posting the new Privacy Policy in the App and updating the “last updated” date at the top of this Privacy Policy.
You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted in the App.
7. Compliance with New Zealand Law
Our App is commissioned to complying with the Privacy Act 2020 and the New Zealand Privacy Principles (NZPPs) established by the Act. The following provisions are in accordance with New Zealand law:
a) Principle 1 – Purpose of Collection
We will only collect Personal Information for a lawful purpose that is directly related to the functioning of our App and services.
b) Principle 2 – Source of Information
We will collect Personal Information directly from the individuals concerned unless it is publicly available, the individual authorizes collection from a third party, or collection from a third party would not prejudice the individual’s interests.
c) Principle 3 – Collection of Information from Subject
When collecting Personal Information, we will inform the individual about the purpose for which the information is being collected, the intended recipients, and the individual’s rights to access and correct their Personal Information.
d) Principle 4 – Manner of Collection
We will collect Personal Information in a manner that is lawful, fair, and does not intrude upon the individual’s personal affairs.
e) Principle 5 – Storage and Security
We will take reasonable steps to ensure the Personal Information we collect is protected against unauthorized access, disclosure, alteration, or destruction.
f) Principle 6 – Access
Individuals have the right to request access to their Personal Information held by us. We will provide access in accordance with the Privacy Act 2020, and may charge a reasonable fee for doing so.
g) Principle 7 – Correction
Individuals have the right to request the correction of any Personal Information held by us if they believe it is inaccurate, incomplete, or out-of-date. We will take reasonable steps to ensure the information is corrected.
h) Principle 8 – Accuracy
We will take reasonable steps to ensure the Personal Information we hold is accurate, up-to-date, complete, relevant, and not misleading.
i) Principle 9 – Retention
We will not retain Personal Information longer than necessary for the purpose for which it was collected.
j) Principle 10 – Use of Information
We will only use Personal Information for the purpose it was collected unless the individual has given consent for further use, or the use is directly related to the original purpose.
k) Principle 11 – Disclosure of Information
We will not disclose Personal Information to third parƟes unless the individual concerned has given consent, the disclosure is directly related to the purpose for which the information was collected, or the disclosure is required by law.
l) Principle 12 – Unique Identifiers
We will only assign unique identifiers to individuals where it is necessary for the functioning of our App and services, and will take reasonable steps to protect the privacy of these identifiers.
By using our App, you acknowledge and agree that you have read, understood, and consent to the collection, use, disclosure, and protection of your Personal Information in accordance with this Privacy Policy and New Zealand law.
